According to the British publication The Guardian, on Friday, the Baltimore police officers being prosecuted over the death of Freddie Gray threatened to sue the city’s top prosecutor, Marilyn Mosby, for arresting them.
They threatened the lawsuit as they demanded that she step down from their case over alleged conflicts of interest.
“As part of a barrage of hostile court filings that also sought to dismiss all charges against the officers on technical grounds, their lawyers attacked Mosby, the state’s attorney for Baltimore, who announced their charges in the Gray case in a shock statement last Friday,” writes The Guardian.
In an “extraordinary 109-page motion,” the officers’ lawyers said all six may sue Mosby and mayor Stephanie Rawlings-Blake for arresting and detaining them unless the city pays them tens of thousands of dollars in damages.
“They accused Mosby in sharply personal terms of breaching the US constitution, the Maryland declaration of rights, and her professional code,” writes The Guardian.

“On Thursday, the city and the state each received a notice that the defense believes it has cause to file a civil lawsuit claiming unlawful arrest and detention of the six officers. The officers were justified in their arrest of Gray for an illegal knife, the document says, so detaining them amounted to false imprisonment. The motion also says Mosby’s public comments expose her to civil liability. The letters act as a request for a financial settlement for “more than $75,000″ for each officer.”

According to the Associated Press, attorneys for the six Baltimore police officers charged in the death of Freddie Gray, a man who died of a spinal injury while in custody, asked a judge Friday to dismiss the case or assign it to someone other than the city’s top prosecutor. They claim she has too many conflicts of interest to remain objective.
The lawyers state that at a minimum, State’s Attorney Marilyn Mosby should be replaced with an independent prosecutor.
The motion was filed in Baltimore District Court.
In the latest legal move to challenge the charges, the motion says Mosby’s prosecution has been “overzealous” and “politically motivated.”
Ms. Mosby announced the charges a day after receiving an investigative report from the police. The motion argues that part of the reason she acted so swiftly was to quash protests that gave way to violence in West Baltimore, where Gray was arrested and “where Mosby’s husband, Nick Mosby, is a city councilman,” according to the Associated Press. A separate motion argues that her rapid decision could be at odds with a law that requires a thorough investigation prior to filing charges.

The North Carolina NAACP is reacting to a decision by the two North Carolina U.S. Senators to not support Loretta Lynch as the country’s new attorney general.
Lynch, who grew up in Greensboro, N.C. and went to high school in Durham, was recently grilled by senators on Capitol Hill.
Her responses apparently did not persuade both Republican Senators Richard Burr and Thom Tillis.
Both said her recent comments against North Carolina’s voter ID law, which is being challenged in court, would show she would play politics and pursue “frivolous lawsuits against the state.”
Leaders with the N.C. NAACP said Lynch was more than qualified for the job and the senators’ opposition is regressive.
“They are actively lobbying against the candidacy of Loretta Lynch,” NC NAACP President Rev. William Barber said.
“…(W)hy are you attacking a daughter of North Carolina who has done everything right to come to this place?” asked Barber.
Lynch does have Republican support from two other senators.
Her nomination was approved by the Senate Judiciary Committee, but it’s unclear when the full Senate will take up the vote.

Wekipedia states that Jesselyn Radack is a former ethics adviser to the United States Department of Justice who came to prominence as a whistleblower after she disclosed that the Federal Bureau of Investigation (FBI) committed what she believed to be an ethics violation in their interrogation of John Walker Lindh (the “American Taliban” captured during the 2001 invasion of Afghanistan) without an attorney present, and alleged that the Department of Justice attempted to suppress that information. The Lindh case was the first major terrorism prosecution after 9/11.
Her experience is chronicled in her memoir, TRAITOR: The Whistleblower and the “American Taliban”.
She is a national security and human rights attorney, known for her defense of whistleblowers, journalists, and hacktivists.
William Binney is a former highly placed intelligence official with the United States National Security Agency (NSA) turned whistleblower who resigned on October 31, 2001, after more than 30 years with the agency.
He was a high-profile critic of his former employers during the George W. Bush administration.
Binney continues to speak out during Barack Obama’s presidency about the NSA’s data collection policies, and continues interviews in the media regarding his experiences and his views on communication intercepts by governmental agencies of American citizens. In a legal case, Binney has testified in an affidavit that the NSA is in deliberate violation of the U.S. Constitution.

Recently, a Black police officer in the St. Louis county police department was charged with a felony after hitting a person on the hand with his baton, even though officer Darren Wilson did not get charged with any crime at all.
Is this appropriate, and why would that be?
Dawon Gore, a Black 13-year veteran of the St. Louis County Police Department, was charged with felony assault after striking a MetroLink passenger on the hand with his expandable baton following an argument, according to CBS St. Louis.
CBS St. Louis reports, Gore is accused of using excessive force against an unnamed 24-year-old light-rail passenger in late April at the Hanley Road station in Clayton.
According to a police press release, the investigation was forwarded to prosecutor Bob McCullough, the same prosecutor who did not charge Darren Wilson, a white Ferguson police officer in the murder of Mike Brown, an unarmed Black teenager.
The investigation was sent to McCullough with a recommendation to press charges, which is what he did. Gore, who is a 44-year-old Ferguson resident, was charged with second-degree assault. He was jailed on a $3,500 with a cash-only bond.
Sources claim Gore is currently in jail.
